In the March issue of the Assagenti Newsletter, lawyer Enrico Ottonello analyses the updated versions of the two contractual models for crew management, known as CREWMAN A (remuneration calculated on a cost plus fee basis) and CREWMAN B (remuneration calculated on a lump sum basis).
The new models include a series of clauses developed by BIMCO after the publication of the previous editions of the models in 2009, including the 2020 Law and Arbitration Clause, the 2021 Mediation/Alternative Dispute Resolution Clause, the 2009 Personal Data Protection Clause for CREWMAN A and B, the 2021 Electronic Signature Clause, the 2019 Cyber Security Clause and the 2009 MLC Clause, as well as entirely new clauses, such as those relating to so called “pre delivery services”, namely crew management services provided by the crew manager even before the actual start date of the crew management agreement, as well as clauses concerning the shipowner’s access to crew management data through the crew managers’ information system and the transfer of such data to the shipowner itself in the event of termination of the agreement.
